You will receive an invoice to the email provided above which you can pay either online using a Credit Card or with cash/check at your first class. Cash and check payments are always appreciated as it saves us 3% in fees. A class must have at least 5 students registered to run. If fewer than 5 students sign up for your chosen class, you will be offered a spot in another class or a full refund.
GENERAL CLASSROOM POLICIES

-Please make every effort to arrive on time. Young children need and enjoy ritual behaviors, so it's very important for them to be here for the Hello song. This is a way for everyone to settle in and get comfortable with the classroom surroundings. If you do arrive after class starts, please enter quietly and participate as soon as you are able.

-Children must be with an adult at all times. The teacher cannot be responsible for your child - please do not ask the teacher to watch your child during class. You are solely responsible for your child(ren).

-We ask that children do not run in class. It is okay if they want to explore, but they should stay on the mats and do so in a safe way. If you have a very active child, try getting up and moving with them in order to engage in a musical behavior. If that doesn't work to modify the running impulse, you may need to step outside for a minute, then return to the class. Feel free to speak to the teacher about other solutions if this becomes a problem. One other rule for children is that, when we use rhythm sticks, they need to sit. If a child wants to move during a stick tune, it's okay, as long as you keep their sticks; again, for safety.

PAYMENT AND MAKE-UP POLICY- Make-up classes may be requested through email to confirm there is space for you in the requested class; Make-up classes may not be transferred to other sessions; In the event we do not fill a class with the minimum registration of 5 students, you will be offered a chance to switch into one of our other classes or receive a full refund.

INCLEMENT WEATHER POLICY - In the event of inclement winter weather, lessons and classes will be rescheduled when possible, or make-up classes/class credits (for following sessions if there isn't enough time in the current session for make-ups) will be arranged.

CONSENT FOR USE OF PHOTOGRAPHY AND VIDEO BY EXLER MUSIC STUDIO LLC

I give my consent to Exler Music Studio LLC to take and use visual/audio images of me and/or my child(ren). "Visual/audio images" includes any type of recording whatsoever including but not limited to photographs, digital images, sound or video recordings, or audio clips. I agree that Exler Music Studio owns the images and all rights related to them. The images may be used in any manner or media without notifying me in advance. Such potential uses include educational, promotional, advertising, and trade, through any medium or format, including, but not limited to, videotape, audiotape, film, photograph, television, radio, digital, or internet and may appear on Exler Music Studio's website and in publications, promotions, broadcasts, advertisements and posters. I waive my right to inspect or approve the finished images or any printed electronic matter that may be used with them, or to be compensated for them. I understand that I will receive no consideration, monetary or otherwise, regardless of whether or not the project, or any part thereof is published. I release Exler Music Studio and those acting pursuant to its authority from liability for any violation of any personal or proprietary right I may have in connection with such recording or use. I hereby freely and voluntarily consent to the use and publication of the images by Exler Music Studio from this date forward until I revoke this consent in writing.

WAIVER OF LIABILITY AND HOLD HARMLESS AGREEMENT

1. In consideration for participating in Early Childhood Music or Music Lesson activities in and around The Arlington Common, 3938 Vermont Rte 7a, Arlington, VT 05250 or any other premise classes/lessons are being held (the “Premises”), I, on behalf of myself and my child, hereby RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE Exler Music Studio LLC, and its members, shareholders, managers, officers, agents, or employees, jointly and severally, together with their respective successors and assigns (hereinafter referred to, collectively, as Releasees) from any and all liability, claims, demands, actions, and causes of action, whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or to any property belonging to me, specifically including, but not limited to, any loss, damage, or injury, including death, that may be sustained by me or my child related to COVID-19, while participating in such activity, while in, on or upon the Premises, regardless of whether such loss is caused by the negligence of the Releasees, or otherwise and regardless of whether such liability arises in tort, contract, strict liability, or otherwise, to the fullest extent allowed by law.

2. I am fully aware of the risks and hazards connected with the activities engaged in/on the Premises, and I am aware that such activities include the risk of injury and even death, and I hereby elect, on behalf of myself and my child, to voluntarily participate in said activities and either avail or not avail myself of any safety equipment which may be provided, knowing that the activities may be hazardous to my property and me. I voluntarily assume full responsibility for any risks of loss, property damage, or personal injury, including death, that may be sustained by me or my child, or any loss or damage to property owned by me or my child, as a result of being engaged in such activities, whether caused by the negligence of Releasees or otherwise, to the fullest extent allowed by law.

3. I agree that I personally responsible for my safety, and the safety of my child, while engaging in Exler Music Studio LLC services. I agree to comply with all Exler Music Studio LLC policies and rules, including, but not limited to, all Exler Music Studio LLC guidelines, signage and instructions. I understand and acknowledge that as space utilized by Exler Music Studio LLC is open for use by other individuals, I am at higher risk of contracting COVID-19. I further hereby agree to indemnify and hold harmless the Releasees from any loss, liability, damage, or costs, including court costs and attorneys' fees that Releasees may incur due to my participation in said activities, whether caused by negligence of Releasees or otherwise, to the fullest extent allowed by law.

4. By checking the above box, I acknowledge and represent, for myself and on behalf of my child, that I have read the foregoing waiver of liability, understand it and sign it voluntarily as my own free act and deed; no oral representations, statements, or inducements, apart from the foregoing written agreement, have been made; I am sufficiently informed about the risks involved in participating in activities through Exler Music Studio LLC to decide whether to sign this document; I am at least eighteen (18) years of age and fully competent; and I execute this Waiver on behalf of myself and my child for full, adequate, and complete consideration fully intending to be bound by same. This Waiver shall be governed by and construed in accordance with Vermont law. If any of the provisions are found to be unenforceable, I agree that the remainder shall be enforced as fully as possible and the unenforceable provision(s) shall be deemed modified to the limited extent possible to permit enforcement of the Waiver as a whole.

5. It is my express intent that this Waiver and Hold Harmless Agreement shall bind the members of my family and spouse and my child’s family, if I am alive, and my heirs, assigns and personal representative and those of my child, if I am deceased, and shall be deemed as a release, waiver, discharge, and covenant not to sue the above-named Releasees. I hereby further agree that this Waiver of Liability and Hold Harmless Agreement shall be construed in accordance with the laws of the State of Vermont and that any mediation, suit, or other proceeding must be filed or entered into only in Vermont and the federal or state courts of Vermont, Bennington County. Any portion of this document deemed unlawful or unenforceable is severable and shall be stricken without any effect on the enforceability of the remaining provisions.
