You will receive an invoice to the email provided above which you can pay either online using a Credit Card or with cash/check at your first class. Cash and check payments are always appreciated as it saves us 3% in fees. A class must have at least 5 students registered to run. If fewer than 5 students sign up for your chosen class, you will be offered a spot in another class or a full refund.
GENERAL CLASSROOM POLICIES

Arriving for Class

Please plan to arrive a few minutes before your scheduled class so that your child has time to settle in. Our opening “Hello” song is an important part of our routine and helps children transition into the class and become comfortable in the space.

If you arrive after class has begun, please come in quietly and join the group when you are ready.

Adult Supervision

A parent, caregiver, or other responsible adult must remain with each child for the entire class. Exler Music Studio teachers are responsible for leading the class and cannot provide individual childcare or supervision.

Please do not leave your child unattended or ask the teacher to supervise your child while you step away. The accompanying adult remains responsible for the child throughout the class.

Safe Movement in the Classroom

Music classes are active and children are encouraged to move, explore, dance, and participate in ways that are appropriate for their age. For everyone's safety, however, children should not run through the classroom.

Children may explore the classroom and move around the mats, provided they are doing so safely. If your child has a strong urge to run or move away from the group, we encourage you to join them and redirect that energy into a musical activity.

If you are unable to redirect the behavior, you may step outside the classroom briefly with your child and return when they are ready to rejoin the group. Please feel welcome to talk with the teacher if you are having difficulty managing your child's participation; we are happy to work with you on strategies that may help.

Rhythm Sticks and Other Instruments

For activities involving rhythm sticks, children must remain seated while holding the sticks. If your child would like to move during a rhythm-stick activity, the accompanying adult should hold the sticks while the child moves.

These guidelines are intended to make the classroom enjoyable and safe for everyone.

PAYMENT AND MAKE-UP POLICY

Make-up classes may be requested by email and are subject to availability. Please contact Exler Music Studio before attending a different class so that we can confirm that there is room.

Make-up classes are intended for the student originally registered and may not be transferred to another student, family, session, or program.

If a class does not reach the minimum enrollment of five students and Exler Music Studio is unable to run the class, we will offer the family the choice of transferring their registration to another available class or receiving a full refund.

INCLEMENT WEATHER POLICY

Vermont weather can occasionally make travel unsafe or prevent classes from being held as scheduled. When severe winter weather requires a class to be canceled, Exler Music Studio will make reasonable efforts to reschedule the class whenever possible.

Depending on the timing of the cancellation and the remaining schedule, families may instead receive a make-up class or class credit toward a future session if there is not sufficient time to reschedule within the current session.

We will communicate weather-related cancellations and any available make-up arrangements as promptly as possible.

CONSENT FOR PHOTOGRAPHY, VIDEO, AND AUDIO RECORDINGS

Exler Music Studio may occasionally photograph, videotape, or make audio recordings during classes, lessons, performances, or other studio activities. These recordings may include students, parents, caregivers, teachers, or other participants.

If you do **not** want your child photographed, videotaped, or recorded, please notify Exler Music Studio in writing at **[exlermusicstudio@gmail.com](mailto:exlermusicstudio@gmail.com)**.

By providing consent, I authorize Exler Music Studio LLC to photograph, videotape, record, and otherwise capture my image, voice, and/or the image or voice of my child(ren) in connection with Exler Music Studio activities.

For purposes of this consent, recordings may include photographs, digital images, video recordings, audio recordings, or combinations of these formats.

I understand that Exler Music Studio LLC may use these recordings for purposes related to the studio, including educational materials, studio communications, promotional materials, advertising, social media, its website, printed materials, and other public or digital communications.

I understand that Exler Music Studio may edit, reproduce, publish, display, or distribute these recordings in these contexts without additional notice to me or additional approval from me.

I waive any right to inspect or approve the finished materials before they are used and understand that I will not receive payment or other compensation for the use of these recordings.

To the extent permitted by law, I release Exler Music Studio LLC and individuals acting with its authorization from claims arising from the authorized use of these photographs, recordings, or other materials.

This consent will remain in effect unless and until I revoke it in writing. Revocation will apply to future use and does not require Exler Music Studio to recall or remove materials that have already been produced, published, distributed, or otherwise used before the revocation was received.

WAIVER OF LIABILITY AND HOLD HARMLESS AGREEMENT

I understand that participation in early childhood music classes, private music lessons, performances, and other activities offered by Exler Music Studio LLC involves ordinary risks associated with participating in physical, musical, and group activities and with being present in spaces used by the studio.

These activities may take place at The Arlington Common, 3938 Vermont Route 7A, Arlington, Vermont 05250, or at other locations used by Exler Music Studio LLC (collectively, the “Premises”).

In consideration of being permitted to participate in Exler Music Studio LLC activities, I agree to the following on behalf of myself and, to the extent I am legally permitted to do so, my participating child or children.

1. Release of Claims

I release and discharge Exler Music Studio LLC and its members, managers, officers, employees, instructors, agents, representatives, successors, and assigns (collectively, the “Released Parties”) from claims for injury, death, property damage, or other loss arising from my or my child's participation in studio activities or presence on the Premises, except to the extent such a release is prohibited by applicable law.

This release applies to claims arising from the ordinary risks associated with participation in these activities and from the acts or omissions of the Released Parties to the fullest extent permitted by Vermont law.

2. Assumption of Risk

I understand that participating in music classes and lessons may involve risks, including falls, collisions, contact with classroom materials or instruments, and other injuries that can occur during group activities.

I have considered these risks and voluntarily choose to participate, and I accept responsibility for the risks ordinarily associated with these activities to the fullest extent permitted by law.

I understand that I am responsible for determining whether I or my child is able to safely participate in a particular activity and for following reasonable safety instructions provided by Exler Music Studio LLC and its instructors.

3. Responsibility for Safety and Compliance

I agree to act responsibly while participating in Exler Music Studio LLC activities and to supervise my child at all times.

I will follow the studio's classroom policies, safety instructions, posted rules, and reasonable directions from teachers and staff. I understand that Exler Music Studio LLC uses spaces that may also be occupied by other people and that the studio cannot control every condition or activity occurring in those spaces.

I agree to indemnify and hold the Released Parties harmless, to the fullest extent permitted by law, from claims, losses, damages, costs, or expenses arising from my own actions or from my failure to comply with applicable studio policies and safety instructions.

4. Acknowledgment and Agreement

By checking the acknowledgment box associated with this agreement, I confirm that:

* I have read and understand this Waiver of Liability and Hold Harmless Agreement;
* I am voluntarily agreeing to its terms;
* I have had an opportunity to ask questions about the agreement;
* I understand that participation in Exler Music Studio activities is voluntary;
* I am at least eighteen (18) years old and legally competent to enter into this agreement; and
* I am signing this agreement on behalf of myself and, to the extent permitted by law, my participating child or children.

This agreement represents the understanding between the parties concerning the matters addressed here and supersedes prior oral representations concerning those matters.

This agreement shall be interpreted under the laws of the State of Vermont. If any provision is determined to be invalid or unenforceable, that provision shall be limited or removed to the minimum extent necessary, and the remaining provisions shall continue in effect to the fullest extent permitted by law.

5. Binding Effect and Venue

To the extent permitted by law, this agreement is intended to be binding upon me and my participating child or children, as well as our respective heirs, personal representatives, successors, and assigns.

Any legal proceeding arising from or relating to this agreement shall be brought in a court of competent jurisdiction in the State of Vermont, unless applicable law requires otherwise.
